
Payment Terms & Conditions
These Payment Terms and Conditions form part of the Agreement between you, the Client, and Armaani Estates ("We", "Our", "Us"). They outline the fees, payment terms, and cancellation policies applicable to the services we provide to market and sell your property.
1. Upfront Fees
1.1 Fee Structure Upon entering into this Agreement, the Client agrees to pay an upfront fee of £599. This fee is non-refundable and covers the following services:
Property Listing Creation: The preparation and listing of your property on our website and third-party property portals, including Rightmove and Zoopla.
Professional Photography: High-quality professional photography, including interior and exterior photos of the property.
Viewings: All property viewings will be conducted by an Armaani Estates Agent, ensuring that your property is presented professionally to prospective buyers.
Marketing Services: Marketing materials will be created and distributed to potential buyers, including floor plans and property descriptions.
This upfront fee is payable in full at the time of instructing us to market your property and is due before any marketing services are provided.
1.2 Payment Methods The £599 upfront fee can be paid through the following methods:
Credit or debit card via our secure payment system.
Bank transfer (details will be provided upon request).
Other payment methods as agreed in writing.
Upon receipt of the upfront payment, we will begin processing the marketing of your property and the associated services.
2. Conveyancing Solicitor Services
2.1 Offer of Conveyancing Services As part of our services, we offer the opportunity to instruct a conveyancing solicitor through Armaani Estates to assist with the legal aspects of your property sale. By using our recommended conveyancer, you may receive a competitive fee structure for these services.
2.2 Referral Fees We may receive a referral fee or commission from the conveyancing solicitor for referring you to their services. This referral fee will not affect the cost of the conveyancing services provided to you, and we will provide full disclosure if you choose to use this service. You are under no obligation to use the conveyancing solicitor recommended by us and are free to select your own solicitor if you prefer.
2.3 Payment for Conveyancing Services If you choose to use our conveyancing solicitor, payment for their services will be due separately. The costs associated with conveyancing will be clearly outlined in the service agreement between you and the conveyancing solicitor. These costs are separate from our £599 upfront fee and must be settled directly with the conveyancer.
3. Cancellation and Refunds
3.1 Cancellation Right Within 14 Calendar Days You have the right to cancel this Agreement within 14 calendar days of signing, provided that we have not yet commenced marketing the property. If you choose to cancel within this period and we have not started any marketing activity, we will refund the £599 upfront fee in full.
3.2 Commencement of Marketing: Marketing will be deemed to have commenced as soon as we have prepared your property listing and made it live on any third-party property portals, or as soon as we have created and distributed marketing materials, including photographs and floor plans. Once marketing has commenced, you will not be entitled to a full refund of the £599 upfront fee.
3.3 Cancellation After Marketing Has Commenced In the event that you decide to cancel the Agreement after marketing has started, NO refund of the £599 upfront fee will be provided. This fee is non-refundable once the marketing process is underway, as we have already incurred costs in preparing and launching your property listing.
3.4 Additional Services Should you opt for any additional services beyond the standard package, such as premium listings, enhanced marketing, or other optional services, payment for these services will be required upfront. Once these services are provided, they are non-refundable.
4. Fees for Additional Services
4.1 Extra Products and Services We offer a range of optional additional services, including, but not limited to:
Premium Listings: Enhanced property listings on third-party portals such as Rightmove or Zoopla.
Floor Plan Design: Custom-designed floor plans for marketing purposes.
Video Tours: High-quality video tours of your property.
EPC: We will provide your energy performance certificate.
These additional services are available for purchase through Armaani Estates, and you will be informed of the pricing at the time of requesting these services. All additional service fees will be payable upfront, and they are non-refundable once the services have been provided.
4.2 Non-Refundable Nature of Additional Services Please note that any additional products or services you choose will be non-refundable once provided. This includes, but is not limited to, premium listings, professional photography, or enhanced advertising options. We recommend considering these services carefully before making a purchase.
5. Payment for Conveyancing Solicitor Services
If you choose to use the conveyancing solicitor referred by Armaani Estates, the costs for these services will be due directly to the solicitor. The costs and payment terms for conveyancing services will be clearly outlined in the agreement between you and the solicitor.
We do not hold responsibility for the payment of any conveyancing fees or other third-party services. The payment for such services must be made in accordance with the conveyancer's terms and conditions.
6. Failure to Pay
6.1 Non-Payment of Fees If any payments due under this Agreement are not received by the specified due date, we reserve the right to suspend or cease marketing your property until payment is made.
6.2 Termination of Agreement In the event that payment is not made within 14 days of the due date, Armaani Estates reserves the right to terminate this Agreement with immediate effect. In this case, we will cease all marketing activities, and no refund will be provided.
7. Liability and Disputes
7.1 Liability for Fees The £599 upfront fee and any additional service fees are non-refundable except as provided in these Payment Terms and Conditions. In the event of a dispute regarding payments, we will work with you to resolve the matter as swiftly and fairly as possible.
7.2 Dispute Resolution If you have a dispute regarding any payment or fee, we encourage you to contact us directly via email or telephone. In the event that a dispute cannot be resolved directly between us, we may refer the matter to an independent third-party dispute resolution service.
8. Changes to Payment Terms
8.1 Payment Upon Sale or Expiry of Marketing Period
Our goal is to provide the best possible service to help you sell your property. If we have marketed your property for six (6) months and it has NOT been sold, we will remove the listing from the market. In this case, the full amount agreed upon for our services will still be due, as we will have delivered the services outlined in our agreement. Additionally, if the property is sold within six (6) months after the conclusion of our marketing period, any remaining balance owed to us will need to be paid in full upon the sale of the house.
8.2 Notice of Changes
We will notify you of any material changes to these terms with at least thirty (30) days' notice before they take effect. If you do not accept the changes, you may cancel the Agreement in accordance with the cancellation policy outlined above.
8.3 Amendments to Payment Terms
We reserve the right to amend or update these Payment Terms and Conditions from time to time. Any changes will be communicated to you in advance, including adjustments to fees or payment structures. If you are not satisfied with any changes, you may have the right to terminate the Agreement and request a refund for any services not provided.
