Before using Our Site, it is essential that you read and understand these General Terms and Conditions (“Terms”) in full. These Terms apply to Armaani Estates customers in England, Wales, Scotland, and Northern Ireland.

By instructing us to act as your agents for the sale of your property, you confirm that you have read, understood, and accepted these Terms as required under the Estate Agents Act 1979.

Please review these Terms carefully along with the Armaani Estates privacy policy, your Service Agreement with Armaani Estates, and the Armaani Estates cookie policy, which contain important information that you should be aware of before using Our Site and any of our Products and Services. Capitalized terms have specific meanings, as do ‘you’, ‘your’, ‘we’, ‘us’, and ‘our’. Their corresponding definitions will either appear in quotation marks within these Terms or in the definitions section at the end.

In these Terms, the following words and phrases shall have the following meanings, unless the context requires otherwise:

  • 'Local Armaani Agent’ refers to the individual(s) licensed by us to conduct Market Appraisals, Accompanied Viewings (as detailed in the section headed ‘Additional Services and Products’) and other related services concerning the Property;

  • ‘Our Site’ means the Armaani Estates website www.armaaniestates.com

  • 'Property' refers to the residential property in the United Kingdom (excluding Northern Ireland) that you have requested a Local Armaani Agent to appraise or have instructed us to advertise for sale;

  • 'Purchaser’ refers to the individual(s) purchasing the Property;

  • 'Seller’ refers to the owner(s) of the Property or the individual(s) who are entitled to sell the Property;

  • ‘we’, ‘us’, ‘our’ means Armaani Estates Limited; and

  1. Our Site is owned and operated by Armaani Estates Limited, a company registered in the United Kingdom under company number (no. 16216886).

  2. We offer estate agency services to individuals and businesses to facilitate property sales within the United Kingdom (excluding Northern Ireland).

  3. We are members of The Property Ombudsman scheme and adhere to The Property Ombudsman Code of Practice for Residential Estate Agents, accessible at www.tpos.co.uk. We are also registered with The Property Ombudsman’s Approved Estate Agents Redress Scheme.

2. Content on Our Site

  1. We reserve the right to update Our Site and modify its content at any time. However, the content may be outdated at any given moment, and we are not obliged to update it immediately.

  2. We do not guarantee that Our Site, or any content on it, will be free from errors or omissions. We reserve the right to correct any errors at any time.

3. Access to Our Site

    2. Harasses, upsets, embarrasses, alarms, or annoys any person;

    3. Is offensive, threatening, obscene, or hateful;

    4. Is defamatory or libellous;

    5. Promotes illegal activities;

    6. Abuses or invades another’s privacy;

    7. Infringes any intellectual property rights;

    8. Contains false or misleading information;

    9. Deceives any person;

    10. Breaches any legal duty owed to a third party;

    11. Impersonates any person or misrepresents your identity;

    12. Advocates, promotes, or assists any unlawful act.

  2. You warrant that you will comply with these content standards when using any feature that allows you to upload content to Our Site or to make contact with other users. You will be liable to us for any breach of that warranty, including any loss or damage we suffer as a result.

  3. We have the right to remove any posting you make on Our Site if, in our opinion, it does not comply with the content standards set out in this section. You must not repost any content that we have removed.

7. Accessing Your Personal Information and Content

  1. You acknowledge and agree that we may, without liability to you, access, use, preserve, and/or disclose your account information, along with any associated secondary contacts and any content uploaded onto Our Site, to law enforcement authorities, government officials, and/or third parties if required by law or if we believe such actions are necessary to comply with legal processes or to protect us, our users, or any third party.

  2. In some cases, we may disclose your personal data to our affiliates, including our group companies, or third parties. All processing of your personal data will comply with applicable data protection laws.

8. Your Account and Password

  1. If you choose, or you are provided with, a user identification code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

  2. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time if, in our opinion, you have failed to comply with any of the provisions of these Terms.

  1. Our Site may contain links to third-party websites and resources. These links are provided for your information only. We have no control over the content of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

10. Limitation of Liability

  1. To the fullest extent permitted by law, we shall not be liable to you or any third party for any loss or damage, whether direct, indirect, incidental, or consequential, arising from or in connection with the use of, or inability to use, Our Site or any content provided on Our Site.

  2. Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

12. Governing Law and Jurisdiction

  1. These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

  1. ‘Local Armaani Agent’ means the individual(s) licensed by us to conduct Market Appraisals, Accompanied Viewings, and other related services concerning the Property.

  2. ‘Our Site’ means the Armaani Estates website www.armaaniestates.com

  3. 'Property' means the residential property in the United Kingdom (excluding Northern Ireland) that you have requested a Local Armaani Agent to appraise or have instructed us to advertise for sale.

  4. 'Purchaser’ means the individual(s) purchasing the Property.

  5. 'Seller’ means the owner(s) of the Property or the individual(s) who are entitled to sell the Property.

  6. ‘we’, ‘us’, ‘our’ means Armaani Estates Limited.
